The Trump Administration Requests Supreme Court Permission for Military Reserve Troop Deployment in Chicago Area
On the end of the week, the White House submitted an urgent appeal to the nation's highest court, seeking clearance to station state guard forces to the state of Illinois.
This action is part of a larger campaign to expand the domestic use of the military in a number of cities run by Democrats.
Court Fight Over Military Presence
In an emergency filing, the federal legal authorities pressed the bench to set aside a earlier court order that had stopped the stationing of a few hundred national guard members to the greater Chicago.
The presiding judge had voiced concerns about the White House's explanation for sending troops, doubting its reasoning in given local conditions.
A federal appeals court supported the initial ruling on midweek, maintaining the stationing on pause while the legal challenge moves forward.
White House's Justifications
The top government lawyer, speaking on behalf of the administration, wrote in the latest petition that government officers have often been “intimidated and attacked” in Chicago and the suburb of Broadview.
This site is home to an Immigration and Customs Enforcement detention center.
The president has already dispatched national guard forces to the Windy City and the city of Portland, following previous deployments to LA, Memphis, Tennessee, and Washington, District of Columbia.
The White House has claimed that military intervention is required to curb unrest and bolster border control.
Partisan Pushback
Opposition leaders have strongly opposed the action, saying that the president’s claims are overstated and partisan in nature.
They charge the administration of abusing his executive power to target political rivals.
The judiciary have also voiced skepticism about the government's portrayal of events.
Local leaders state that protests over ICE activities have been primarily small and calm, contrasting with the administration's characterization of “battlefield” situations.
Legal Basis
At the heart of the conflict is the administration's application of a national law authorizing the commander-in-chief to take control of the national guard only in instances of insurrection or when “unable with the standard military to carry out the laws of the United States”.
The government argues that the forces are essential to protect government buildings and officers from activists.
Current Actions
Earlier this month, the government federalized several hundred members of the state guard of Illinois and ordered more guard from Texas personnel into the state.
As local leaders denounced the move, the White House increased his statements, urging the arrest of Chicago’s mayor and the state's chief executive, each a Democrat, alleging them of neglecting to secure ICE personnel.
The state of Illinois and the city of Chicago together took legal action against the White House to block the activation.
On 9 October, Judge April Perry, nominated by President Biden, delivered a temporary injunction preventing the command.
Regional Incidents
At the same time in the Chicago area, at least eleven people were arrested outside the Broadview Ice detention center following serious disputes between local police and protesters.
